Killing the random passer-by was wrong, but at least didn't mess up the other characters. This offense was calculated to ruin what the rest of the party was trying to accomplish -- when your PC starts doing stuff calculated to annoy the other players, there's a serious issue. Depends on the group. It's an interesting complication, and the fictional group of players in OotS has put up with plenty, so they seem to not mind such complications thrown in their path for the sake of the story. I've never played D&D 3.5, but from what I could find on the internet, it does one of the following: -6 decrease to an ability score (minimum 1). -4 penalty on attack rolls, saves, ability checks, and skill checks. Each turn, the target has a 50% chance to act normally; otherwise, it takes no action. From a GM's point of view the problem player doesn't get kicked out, but does get a reprimand, and the other players don't have to stretch to explain why their character's continue to keep company with his.
