This week there have been two big controversies involving our Julia Gillard our Prime Minister, one indirectly and one directly.

 

#1: it was revealed that early this year the party in Opposition -- The Liberals -- had a fund-raising dinner that had a menu that poked fun at the Prime Minister. The menu described a dish called â€"Julia Gillard Kentucky Fried Quail,€“ Small Breasts, Huge Thighs & A Big Red Box".

 

#2 a couple days later Julia was interviews on radio where radio presenter (shock jock) asked if her partner was gay, because he is a hairdresser. The radio presenter was sacked and few days later social media pointe a fund raising event for the shock jock in support of the Liberal Party. The Liberal Party later disassociated itself with the event shock hoc, or it was cancelled, not sure of the outcome.

 

#3 last year another Liberal shock jock who has referred to Julia as Juliar at a private Liberal Party function said that her father (who had just died, hence she was obviously in mourning) had "died of shame". Opposition Leader Tony Abbott described Jones's comments as "wrong and offensive". 2-3 week later in the House of Representatives (Lower House), Tony Abbot said the government had "died of shame". This prompted Julia's famous misogyny speech that went international.

 

#4 The "Peter Slipper affair" easy to show you a YouTube video (goes for 3 mins, below) of the media coverage of the scandal and the Federal Courts response. The disconnect between the Courts ruling and the media's reporting is crystal clear.

 

#5 Tony Abbot and other members of Liberal party stand in front of placards/banners such as "Ditch the Witch" and Juliar….Bob Brown's B*tch. [bov Brown is leader of the Green party which helped the Labor Party to form minority government].

 

And some people here still think there isn't a campaign of character assassination against our PM mainly by members within the Liberal Party and its cheerleaders Murdoch's newspapers. Thankfully some in the media are waking up and saying enough, and our PM and the office she holds deserves respect.

I have reached the firm conclusion that Mr Ashby’s predominant purpose for bringing these proceedings was to pursue a political attack against Mr Slipper and not to vindicate any legal claim he may have for which the right to bring proceedings exists. Mr Ashby began planning that attack at least by the beginning of February 2012. As Mr Ashby and Ms Doane agreed in their texts of 30 March 2012 what they were doing “will tip the govt to Mal’s [brough] and the LNP’s advantageâ€Â.

 

I am satisfied that these proceedings are an abuse of the process of the Court. The originating application was used by Mr Ashby for the predominant purpose of causing significant public, reputational and political damage to Mr Slipper. It contained the scandalous and irrelevant 2003 allegations and assertion about intended reporting of the Cabcharge allegations to the police. To allow these proceedings to remain in the Court would bring the administration of justice into disrepute among right-thinking people and would be manifestly unfair to Mr Slipper. Even though Mr Ashby has now abandoned the 2003 and Cabcharge allegations in their entirety, they did the harm to Mr Slipper that Mr Ashby and Mr Harmer intended when those allegations were included in the originating application. A party cannot be allowed to misuse the Court’s process by including scandalous and damaging allegations, knowing that they would receive very significant media coverage, and then seek to regularise his, her or its pleading by subsequently abandoning those claims.

 

Sexual harassment of anyone, including an employee such as Mr Ashby, is a violation of the person’s human dignity and rights. The Court must always be available for the hearing and determination of bona fide proceedings to vindicate and protect those rights. But for the reasons I have given, Mr Ashby’s pre-dominant purpose in bringing the proceedings was not a proper one.

 

Even though I have not found that the combination was as wide as Mr Slipper alleged in his points of claim, the evidence established that Mr Ashby acted in combination with Ms Doane and Mr Brough when commencing the proceedings in order to advance the interests of the LNP and Mr Brough. Mr Ashby and Ms Doane set out to use the proceedings as part of their means to enhance or promote their prospects of advancement or preferment by the LNP, including by using Mr Brough to assist them in doing so. And the evidence also established that other aspects of the proceedings were an abuse of the process of the Court for the reasons I have given.

 

In other words: the case against Peter Slipper was a political one to slander Julia Gillard and the Government by the LNP -- the branch of the Liberal Party in Queensland. Also the function where menu gate happened was organised by Mal Brough who is mentioned above.
